Every day, officers with the Canada Border Services Agency (CBSA) screen an average of 260,000 travellers at Canada’s ports of entry. The government claims these officers can search electronic devices that you carry with you. This paper examines the legal basis the government uses to justify these searches. It argues that courts will likely find that warrantless device searches, in their current incarnation, violate the privacy rights protected by section 8 of the Charter. It then proposes a Charter-compliant solution that effectively balances the high privacy interests in digital devices with our lower privacy interests at the border, namely by subjecting CBSA to independent, after-the-fact review. This approach would target abusive searches and other misconduct while accommodating the unique challenges of effective border protection.
